These Terms of Service ("Terms") govern your access to and use of the Vectares transport management platform (the "Service"). By creating an account or using the Service you agree to these Terms.
1. The Service
Vectares is a multi-tenant SaaS Transport Management System for road-freight carriers and forwarders: order and dispatch management, fleet and driver records, live telematics tracking, compliance automation (driving times, posting/IMI, cabotage), and a mobile app for drivers and dispatch.
2. Accounts
You must provide accurate company and contact data and keep your credentials confidential. You are responsible for all activity under your account. One account belongs to exactly one company (tenant); data is isolated per company.
3. Acceptable use
You may use the Service only for lawful transport-management purposes and in compliance with applicable law (including EU driving-time, posting and cabotage rules). You may not attempt to access other tenants’ data, reverse-engineer the Service, or disrupt its operation.
4. Fees and credits
Paid features are billed per the plan in your account, including per-order credits. Credits are consumed when orders are created. Unless stated otherwise, fees are exclusive of VAT. Online top-ups (Netopia/Stripe) become available where enabled; until then top-ups are handled by us.
5. Data and telematics
You remain the controller of the personal data you upload (drivers, contacts). We act as processor under the separate Data Processing Agreement (DPA). Continuous GPS tracking of drivers involves personal data — you are responsible for a lawful basis and driver transparency in your organisation.
6. Availability
We aim for high availability but the Service is provided "as is" without an uptime warranty unless agreed in writing. We may perform maintenance and will use reasonable efforts to minimise disruption.
7. Liability
To the maximum extent permitted by law, we are not liable for indirect or consequential damages. Nothing limits liability that cannot be limited by law. Compliance outputs (e.g. ETA, HoS, cabotage, IMI suggestions) are decision support — the human dispatcher/manager remains responsible for the final decision.
8. Term and termination
You may stop using the Service at any time. We may suspend or terminate access for material breach. On termination you can export your data for a reasonable period, after which it may be deleted per our retention policy.
9. Changes
We may update these Terms; material changes will be notified in-app or by email. Continued use after the effective date constitutes acceptance.
10. Governing law & contact
These Terms are governed by the law of the provider’s seat, without prejudice to mandatory consumer/AEO rules. Questions: office@digiohs.com.
